Welcome to ModaMike. These Terms and Conditions govern your access to and use of the ModaMike website at modamike.com (the "Site") and any purchase you make through it. ModaMike is an online retailer of genuine generic medications. Please read these terms carefully before browsing, registering, or placing an order. By using the Site you agree to be bound by the terms set out below.

1. Acceptance of these terms

By accessing the Site, creating an account, or placing an order, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions and by any policies referenced within them, including our Refund & Returns Policy and our Privacy Policy. If you do not agree with any part of these terms, please do not use the Site or place an order.

These terms apply to all visitors and customers. Together with the documents they reference, they form the entire agreement between you and ModaMike regarding your use of the Site.

2. Eligibility

To use the Site and place an order, you must be of legal age to enter into a binding contract and to purchase the products offered in your country, region, or jurisdiction. By placing an order you represent and warrant that:

  • you are of legal age and have the legal capacity to enter into these terms;
  • you are ordering for personal, non-commercial use unless you participate in our affiliate program;
  • you are responsible for ensuring that the products you order may lawfully be imported and used at your delivery address; and
  • the information you provide during checkout is accurate, current, and complete.

You are solely responsible for understanding and complying with the laws that apply to you, including any rules concerning the importation and personal use of medications in your location.

3. Product information and no medical advice

The products sold by ModaMike are generic medications. We aim to describe our products accurately, but product descriptions, images, and any general information provided on the Site are for informational purposes only.

Nothing on the Site constitutes medical, pharmaceutical, or professional advice. Information provided about any product is not a substitute for the guidance of a qualified healthcare professional. We make no therapeutic, efficacy, or safety claims about any product. You should consult a qualified healthcare professional before using any medication, particularly if you have a medical condition, are taking other medications, or are pregnant or breastfeeding. You use any product you purchase at your own discretion and responsibility.

4. Ordering and order acceptance

When you place an order through the Site, you are making an offer to purchase the selected products subject to these terms. An order is not accepted, and no contract is formed, until we confirm acceptance and process your order.

We reserve the right to refuse, cancel, or limit any order at our discretion, including where:

  • a product is unavailable or has been mispriced;
  • we are unable to verify your payment or delivery details;
  • we reasonably believe the order is fraudulent or breaches these terms; or
  • delivery to the requested destination is not possible.

If we cancel an order for which payment has already been taken, we will arrange an appropriate refund. You can review the status of your order at any time using your Order ID and the billing email used at checkout at our Track Order page.

5. Pricing, promotional discount, and payment

5.1 Prices and discounts

Prices are displayed on the Site and are subject to change without notice; however, the price applicable to your order is the price shown at the time you complete checkout. A 20% promotional discount currently applies at checkout. Promotional offers are provided at our discretion and may be modified, suspended, or withdrawn at any time. Prices do not include any import duties, taxes, or charges that may be imposed by the authorities at your delivery destination, which are your responsibility.

5.2 Payment methods

We accept the following methods of payment:

  • Card, Apple Pay and Google Pay processed by a third-party checkout partner; and
  • Bitcoin processed through our self-hosted, non-custodial BTCPay Server.

Payment processing is handled by these third parties. ModaMike does not store full card numbers and does not hold or control your cryptocurrency private keys. Card and digital-wallet payments are subject to the terms and security practices of our checkout partner, and Bitcoin payments are subject to the characteristics of the Bitcoin network, including network confirmation times and transaction fees. You are responsible for sending the correct amount to the correct address for cryptocurrency payments.

Your order will be processed once payment has been successfully authorized or, for Bitcoin, once the transaction is confirmed on the network.

6. Shipping and risk

ModaMike offers worldwide shipping as well as express US-to-US delivery. All orders are sent in discreet, non-contact packaging.

  • Delivery timeframes are general estimates only. Express US-to-US orders typically arrive within a few business days, while international orders generally take longer.
  • Delivery times are not guaranteed and may be affected by factors outside our control, including customs processing, carrier delays, and local conditions.
  • You are responsible for providing an accurate, complete delivery address and for any duties, taxes, or charges levied at the destination.

Our reship and refund guarantee, described below, protects you in the event that an order is lost, seized, or does not arrive.

7. Reship and refund guarantee

ModaMike stands behind every order with a 100% money-back / reship guarantee. If an order is lost, seized in transit, or does not arrive, we will reship the order or issue a refund. Full details of how the guarantee works, including how to make a claim and any conditions that apply, are set out in our Refund & Returns Policy, which forms part of these terms. In the event of any conflict between this summary and the Refund & Returns Policy, the Refund & Returns Policy prevails.

8. Acceptable use

When using the Site, you agree that you will not:

  • use the Site for any unlawful, fraudulent, or harmful purpose;
  • provide false, inaccurate, or misleading information, including during checkout or account registration;
  • attempt to gain unauthorized access to the Site, our systems, or other users' accounts;
  • interfere with, disrupt, or place an unreasonable load on the Site or its infrastructure;
  • use any automated means to scrape, copy, or harvest content from the Site without our permission; or
  • resell or redistribute products in breach of these terms or applicable law.

You are responsible for keeping your account credentials confidential and for all activity that occurs under your account. We may suspend or terminate access to the Site for any user who breaches these terms.

9. Intellectual property

All content on the Site, including text, graphics, logos, page layouts, product descriptions, and the ModaMike name and branding, is owned by or licensed to ModaMike and is protected by applicable intellectual-property laws. You may view and use the Site for your own personal, non-commercial purposes. You may not copy, reproduce, republish, distribute, or create derivative works from any part of the Site without our prior written permission, except as expressly permitted under our affiliate program.

10. Affiliate program

ModaMike operates an affiliate program offering up to 25% commission, with a 30-day referral tracking cookie and crypto-only payouts to a wallet address that the affiliate provides. Commissions are paid only in cryptocurrency to the wallet you supply; we do not make payouts by bank transfer. 11. Disclaimers and limitation of liability

The Site and its content are provided on an "as is" and "as available" basis. To the fullest extent permitted by applicable law, ModaMike disclaims all warranties of any kind, whether express or implied, regarding the Site, its content, and the products, except as expressly stated in these terms or in our Refund & Returns Policy.

As noted above, nothing on the Site is medical advice and we make no therapeutic, efficacy, or safety claims. You are responsible for deciding whether any product is suitable for you and for consulting a qualified healthcare professional.

To the fullest extent permitted by applicable law, ModaMike shall not be liable for any indirect, incidental, special, or consequential loss or damage arising out of or in connection with your use of the Site or any product purchased through it. Nothing in these terms excludes or limits any liability that cannot be excluded or limited under applicable law. Where our liability cannot be excluded, it is limited to the amount you paid for the relevant order.

12. Changes to these terms

We may update or amend these Terms and Conditions from time to time to reflect changes to our products, services, practices, or legal requirements. The version published on the Site at the time you place an order is the version that applies to that order. We encourage you to review these terms periodically. Your continued use of the Site after any update constitutes acceptance of the revised terms.

13. Governing law and disputes

These Terms and Conditions, and any dispute or claim arising out of or in connection with them or your use of the Site, are governed by the laws applicable at ModaMike's place of operation, except where mandatory consumer-protection rules in your place of residence provide otherwise. Those mandatory consumer protections continue to apply to you in addition to these terms and are not affected by this clause. We encourage you to contact us first so that we can try to resolve any concern directly before pursuing any formal dispute.
